These terms and conditions form the legal foundation between an Associate and the Polish Australian Chamber of Commerce (“PACC”, previously Polish Australian Business Forum). Registration implies acceptance of these terms.
PACC associateship is available to companies, trusts, publicly listed entities, ABN holders, firms, individuals engaged in business or professions, and directors or executives of public institutions connected with commerce or industry who seek to collaborate with Polish businesses. The PACC executive may limit the number of Associates. Individuals not engaged in business are not eligible.
Fees are invoiced upon joining and annually on the associateship anniversary date. Current fees as of 1 January 2024, inclusive of GST:
Individual — $100. Academic — $200. Corporate — $400. Premium Corporate — $800.
PACC retains the discretion to modify its associateship offerings.
The annual associateship fee is payable in full upfront upon applying or renewing. No refunds apply if an Associate resigns during an associateship year.
Associates may resign by giving written notice to PACC. PACC leadership may terminate an associateship for fees unpaid for seven days or more, inappropriate conduct, harassment, bullying or intimidation, bringing PACC into disrepute, breaching these terms, or any other action deemed contrary to the interests of PACC. No associateship fee already paid, and no registration fee for upcoming events, will be refunded.
An application by one company in a group does not extend eligibility to its parent or subsidiary companies. Each entity must apply separately, or the parent may establish a collective associateship. Only decision-makers attend events, and their number determines the category and the fee.
Each provision contained in these terms and conditions is severable from every other provision. If any part of any provision is found to be invalid, illegal or void for any reason, this will not affect any other part.
These terms supersede all prior agreements, negotiations, representations and proposals regarding associateship.
Associates accept any other terms and conditions of PACC as are in force or amended from time to time, and must familiarise themselves with all such provisions.
These terms and conditions are construed in accordance with the laws of Australia, and the parties submit to the exclusive jurisdiction of the Australian courts.
No rights under these terms extend to anyone who is not a party to them.
Associates cannot assign their rights or obligations without prior written consent from PACC leadership. PACC may assign or delegate its rights upon notification.
PACC gives no warranty or assurance about any recommendation or referral it makes in respect of third parties and the services they supply. All implied warranties are excluded to the maximum extent permitted by law.
Events require advance booking and payment. Failing to attend an event does not entitle you to a refund. Any refunds are entirely at the discretion of the PACC executive.
PACC endeavours to ensure accuracy in its publications and communications. Associates should report any errors they discover so that they can be verified and corrected.
PACC owns the intellectual property, including copyright, in all content of its publications. Reproduction of any PACC publication is not permitted without prior written authorisation.
PACC collects visitor data including IP addresses, domain names, dates and times of visits, pages accessed, browser types and operating systems. This information helps improve services and identify usage patterns. Individual computers are not identified to third parties without consent, except as required by NSW legislation.
By completing the associateship application, you grant PACC permission to use the information uploaded in the associateship profile, including artwork, logos and photos, for marketing purposes. Associates also authorise the use of event photographs for marketing on the website, social media and promotional materials.
Applying requires reading and accepting these terms, and applications are made on forms supplied by PACC. You do not have an automatic entitlement to associateship, and PACC may at its sole discretion refuse your application. Prices, benefits and services are subject to change with the approval of the PACC executive. Associates must notify PACC of any incorrect personal information. Associateship is non-transferable.
Associateship renews annually, with fees that may be adjusted on four weeks’ advance notice. Renewal notices are sent approximately two weeks before the renewal date. PACC has the right to withdraw any or all benefits and services, including associateship discounts, if the annual fee is not received within seven days of the annual renewal date. Fees unpaid after seven days trigger cancellation. Annual renewal fees are non-refundable and non-transferable once paid.
Associateship is cancelled if the annual fee remains unpaid seven days after the due date, and the name is removed from the Associate Register and from social media. Written notice of resignation to the Secretary ends the associateship, but the Associate remains liable for subscription arrears and outstanding debts.
Associate benefits are listed separately and are subject to change.
